Agreement to these terms

These Terms of Service ("Terms") govern your use of arklegalfund.com (the "Site"), operated by Ark Legal Fund ("Ark," "we," "us"). By using the Site or submitting an application, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

No offer or commitment to fund

Content on the Site, including descriptions of our services, amounts, and timing, is general information only. It is not an offer, approval, or commitment to provide funding. All funding is subject to our review of your case with your attorney and to our underwriting standards. Any funding is governed solely by a written funding agreement signed by you and Ark. If anything on the Site conflicts with your signed agreement, the agreement controls.

Funding calculator

The funding calculator uses an example rate to illustrate how simple interest compares with compound interest. Its results are estimates for educational purposes only. Your actual rate, charges, and payoff schedule depend on your case and will be stated in your funding agreement before you sign.

Not legal, tax, or financial advice

Ark is not a law firm and does not provide legal, tax, or financial advice. Nothing on the Site, and no communication with Ark, creates an attorney-client relationship with Ark or with any attorney. Please talk with your own attorney about whether funding is right for you and how it may affect your case.

Your application

When you submit an application, you agree that:

• The information you provide is true, accurate, and complete, and you'll tell us if it changes
• You are authorized to share the information you submit, including your attorney's contact information
• Ark may contact you and your attorney, and may share and receive information with your attorney, to review your application
• Ark may verify your information using public records and other lawful sources

Submitting an application does not obligate you to accept funding, and it does not obligate Ark to provide it.

Communications

By giving us your contact information, you agree that Ark may contact you by phone, text message, and email about your application and any funding, as described in our Privacy Policy. You can opt out of texts by replying STOP.

Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to apply for yourself. A legal representative may apply on behalf of a minor or an estate through the attorney handling the claim. Funding may not be available for every type of case or in every location.

Acceptable use

You agree not to:

• Submit false, misleading, or fraudulent information, or apply on behalf of someone without their permission
• Attempt to gain unauthorized access to the Site or its systems, or interfere with how the Site works
• Use bots, scrapers, or automated tools to access or submit forms on the Site
• Use the Site for any unlawful purpose or in violation of these Terms

Intellectual property

The Site and its content, including text, design, graphics, logos, and the funding calculator, belong to Ark or its licensors and are protected by law. You may view and print pages for your personal, non-commercial use. You may not copy, modify, distribute, or reuse Site content without our written permission.

Third-party links and services

The Site may link to or rely on services operated by others. We are not responsible for their content, policies, or availability.

Disclaimer of warranties

The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Site will be uninterrupted, error-free, or secure.

Limitation of liability

To the fullest extent permitted by law, Ark and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or opportunity, arising from your use of, or inability to use, the Site. This section does not limit any rights you have under a signed funding agreement or under laws that cannot be waived.

Indemnification

You agree to defend and hold Ark harmless from claims, losses, and expenses, including reasonable attorneys' fees, arising from your misuse of the Site, your violation of these Terms, or false information you submit.

Governing law and venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute about the Site or these Terms will be brought in the state or federal courts located in Bexar County, Texas, unless your funding agreement says otherwise.

General terms

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, together with our Privacy Policy, are the entire agreement between you and Ark about the Site. Any funding is governed by your separate written funding agreement.

Changes to these terms

We may update these Terms by posting a new version on this page with a new effective date. Your continued use of the Site after changes are posted means you accept them.
