Who we are
This Privacy Policy explains how Ark Legal Fund ("Ark," "we," "us") collects, uses, shares, and protects information when you visit arklegalfund.com (the "Site"), apply for pre-settlement funding, or otherwise communicate with us. By using the Site, you agree to the practices described here.
Information we collect
Information you give us. When you apply or contact us, we collect the information you provide, which may include:
- Your name, phone number, email address, mailing address, and preferred language
- Details about your accident, injuries, treatment, and claim, including the date of the accident and the type of case
- Your attorney's name, phone number, and law firm
- The amount of funding you request, and anything else you choose to tell us
Information from your attorney and others. With your permission, we receive case information from your attorney, such as liability facts, medical records summaries, insurance coverage, and case status. We may also verify information using public court records.
Information collected automatically. When you visit the Site, our hosting and security providers automatically receive basic technical information, such as your IP address, browser type, device type, approximate location (country), the pages you visit, and the page that referred you. If you arrive from an ad or link that includes campaign tags, we may record those tags with your application.
How we use your information
- To review your application and decide whether to offer funding
- To communicate with you and your attorney about your application and funding
- To prepare, sign, fund, service, and collect on funding agreements
- To send you confirmations, updates, and service messages
- To prevent fraud, protect the Site, and keep our records accurate
- To comply with laws, regulations, legal process, and our legal obligations
- To understand how the Site is used and improve it
We do not sell your personal information, and we do not share it with third parties for their own marketing.
How we share information
We share information only as needed to operate our business and serve you:
- Your attorney and their staff, to review and manage your funding.
- Service providers who work on our behalf under confidentiality obligations, such as website hosting and security, email delivery, document storage and spreadsheets, electronic signature, payment processing, and customer relationship management (CRM) tools.
- Professional advisors, such as accountants, auditors, and lawyers.
- Government authorities or others when required by law, subpoena, or court order, or to protect our rights, property, or safety, or that of others.
- A successor business, if Ark is involved in a merger, financing, acquisition, or sale of assets. Your information would remain subject to this policy.
We do not contact the defendant or the defendant's insurance company about your application or funding.
Calls, texts, and email
If you give us your phone number or email address, you agree that Ark may call, text, or email you about your application and funding. Message and data rates may apply. Message frequency varies. You can opt out of texts at any time by replying STOP, and you can ask us to stop calling or emailing you by contacting [email protected]. We will not send marketing texts without your separate consent. Consent to marketing messages is never a condition of funding.
Cookies and similar technologies
The Site uses only the technologies needed to load pages, keep the Site secure, and remember basic preferences. We do not currently use advertising cookies or sell browsing data. The Site loads fonts from Google Fonts, which means Google receives your IP address when the page loads. If we add analytics or advertising tools in the future, we will update this policy.
Most browsers let you block or delete cookies. If you do, parts of the Site may not work as intended.
How we protect your information
We use reasonable administrative, technical, and physical safeguards to protect your information, including encrypted connections (HTTPS) and access limited to people who need it. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.
How long we keep information
We keep information for as long as needed to review your application, service any funding agreement, resolve disputes, enforce our agreements, and meet legal, tax, and recordkeeping requirements. When information is no longer needed, we delete it or make it anonymous.
Your choices and rights
You may ask to access, correct, or delete the personal information we hold about you, or withdraw consent to communications, by emailing [email protected]. We will respond as required by applicable law. We may need to verify your identity, and we may keep certain information when the law requires it or when we need it to service an active funding agreement. Depending on where you live, you may have additional rights under state law.
Children's privacy
The Site is not intended for children under 13, and we do not knowingly collect personal information from them online. Applications must be submitted by an adult or by a legal representative acting on a minor's behalf through their attorney.
Other websites
The Site may link to websites we don't control. We are not responsible for their content or privacy practices, so please review their policies.
Changes to this policy
We may update this policy from time to time. We will post the new version on this page and change the effective date above. Significant changes will be noted on the Site.
