Car accident funding
Car accident funding for injured Texans
Your car is in the shop, the bills keep coming, and the insurance company is taking its time. Ark advances cash against your pending car accident claim so you can keep up while your attorney fights for full value.
Why car accident claims take so long
Most car accident claims don't settle quickly, and that's usually a good thing. A fair settlement has to cover all of your medical care, including treatment you haven't finished yet. Until your doctors know how you'll heal, your attorney can't know what your case is truly worth.
Insurance companies know this, too. Early offers tend to be low because the adjuster knows you're missing paychecks. If the claim turns into a lawsuit, it can take a year or more to resolve. Pre-settlement funding gives you money to live on in the meantime, so you're not pushed into settling early just to pay rent.
What Texas law means for your claim
Every case is different, and your attorney is your best guide. But a few Texas rules shape almost every car accident claim:
- At-fault stateThe driver who caused the crash, and their insurer, pays for the harm.
- 30/60/25Texas minimum liability coverage: $30,000 per injured person, $60,000 per crash, $25,000 property damage.
- 2 yearsThe general deadline to file an injury lawsuit in Texas.
Shared fault doesn't end your case. Texas uses a "modified comparative fault" rule. You can still recover money if you were 50% or less at fault, though your recovery is reduced by your share of the blame.
Your own policy may help, too. Texas insurers must offer personal injury protection (PIP) and uninsured/underinsured motorist coverage. If you didn't reject them in writing, they may cover some costs, or step in when the other driver has little or no insurance.

How much can I get?
Ark advances from $500 to $50,000. The amount depends on your injuries, your treatment so far, and how much insurance is available. Insurance limits matter a lot in car cases: if the at-fault driver carries only the state minimum, we keep the advance modest so most of your settlement still goes to you.
Know your payoff first. We use simple interest, never compounding. Try the funding calculator to see what you'd repay if your case takes 6, 12, or 24 months.
What people use the money for
It's your money to use as you need. Most people cover rent or a mortgage, a car payment or a replacement vehicle, utilities, groceries, and childcare while they recover. Some use it for medical costs their insurance won't pay yet.
Questions
Car accident funding questions
Can I get funding before the insurance company makes an offer?
Yes. Many people apply early, while they're still treating. What matters is that you have an attorney and a pending claim. We review the facts and injuries with your attorney, not a settlement offer.
What if I was partly at fault for the wreck?
You may still qualify. Under Texas law you can recover if you were 50% or less at fault. We'll look at how liability is shaping up with your attorney before making a decision.
The other driver had no insurance. Can I still get funding?
Possibly. If you carry uninsured motorist coverage, your claim may be against your own insurer. Have your attorney tell us what coverage applies and we'll review it.
Do I have to pay anything back if my case loses?
No. Funding is non-recourse. If your case ends without a recovery, you owe nothing.
